1.- Identification of the parties. On one hand, ALEJANDRA RAMIREZ ABOGADOS, operator of the website www.spain-extranjeria.com, owned by Doña Alejandra Ramírez Mesa (hereinafter ALEJANDRA RAMIREZ ABOGADOS), lawyer of the Illustrious Bar Association of Málaga, registered with number 9944, with professional address at Calle Alameda de Colón, 17, 1º A (Málaga), provided with NIF 76,429,302-A, with phone number 687 189 259.

On the other hand, the user, visitor, client, or subscriber (hereinafter referred to as the Client), whose data is the one that has been provided by him in the contracting form. All the data included in the mentioned form have been entered directly by him, so the responsibility for their authenticity corresponds, directly and exclusively, to the Client.These General Conditions of Contracting apply to legal services contracts made through the "Online Services" section of the Website, complementing what is established in the Legal Notice, and have been established by ALEJANDRA RAMIREZ ABOGADOS and accepted by the Client.

In compliance with the duty of information set forth in article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, the following data are reflected below:

The legal representation and responsibility of the domain spain-extranjeria.com (hereinafter, Website) is held by Alejandra Ramírez Mesa, with NIF 76429302A (Alejandra Ramírez Abogados) and address for notifications at Calle Alameda de Colón, 17, 1º A (Málaga).

2.- Justification. In compliance with the provisions of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, as well as Law 7/1998, of April 13, on General Conditions of Contracting, and Royal Decree-Law 14/1999 of December 7, in addition to Royal Decree 1.906/1999, of December 17, regulating telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998, of April 13, on General Conditions of Contracting, as well as other applicable legislation, ALEJANDRA RAMIREZ ABOGADOS establishes the following General Conditions of Contracting for the legal services offered.The period of validity of the General Conditions of Contracting will be the time they remain published on the website, and will refer to the service contracted at the time when these conditions were available. The contracting of the Legal Services implies the full and unconditional acceptance of each and every one of the following General Conditions of Contracting.

3.- Object. The purpose of these General Conditions of Contracting is the lease of Legal Services provided by the lawyers and legal advisors of ALEJANDRA RAMIREZ ABOGADOS, in exchange for fees predetermined by the Firm.In accordance with applicable legislation, to acquire Legal Services, the Client must have the legal capacity necessary for contracting as established by law, understood to possess it by completing the form requesting the provision of Legal Services. If the Client acts on behalf of a legal entity, by accepting these General Conditions of Contracting, they declare to have the necessary powers of representation.

4. - Language
The language for working and responding to the consultation, as well as for formalizing and interpreting this contract, will in any case be Spanish (primarily), English, or French (exceptionally). If the client wishes to contract the provision of legal services in a language other than Spanish, they must consult with the Firm beforehand.

5.- Description of Legal Services and Contracting Methodology. To contract an Online Legal Service, the Client must complete interactively the mandatory fields of the corresponding form and submit their query regarding the area of Spanish law in which the Firm specializes. Under no circumstances will documents, contracts, texts, or other additional contents different from those provided in the Legal Services contracting form be analyzed.In most procedures, the firm will not receive the fees agreed with the client and previously signed in commitment documents until the procedure is completed and proof of it is sent.

According to the client's decision, if the procedure requires a fee payment, the ALEJANDRA RAMIREZ ABOGADOS office will pay them on behalf of the client, and the amount will be added to the fee received at the time.

In the document that the client signs committing to hiring the services of ALEJANDRA RAMIREZ ABOGADOS, the time without penalty for making the payment(s) is stipulated, and in case of non-compliance, a penalty per day of delay must be paid.

The responses to Legal Consultations made by User-Clients are prepared and/or supervised by practicing lawyers or legal advisors licensed in Law; however, their nature is purely indicative and generic based solely on the information provided by the Client in their consultation via the web form.

Such responses do not constitute specific legal advice under any circumstances, which can only be provided by a lawyer/manager based on the relevant documentation and after examining all the circumstances of the matter, not just those provided by the Client.

6. – Exclusion of liability from:

  • THE INFORMATION

Access to the Portal does not imply any obligation on the part of ALEJANDRA RAMÍREZ ABOGADOS to verify the truthfulness, accuracy, adequacy, suitability, completeness, and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of any type of legal or tax advisory service, so this information is insufficient for making personal or business decisions by the User.

ALEJANDRA RAMÍREZ ABOGADOS shall not be held responsible for decisions made based on the information provided on the Portal or for damages and losses incurred by the User or third parties as a result of actions based solely on the information obtained from the Portal.

  • THE QUALITY OF THE SERVICE

Access to the Portal does not imply any obligation on the part of ALEJANDRA RAMÍREZ ABOGADOS to control the absence of viruses, worms, or any other harmful computer element. It is the User's responsibility, in any case, to have suitable tools for the detection and disinfection of harmful computer programs.

ALEJANDRA RAMÍREZ ABOGADOS shall not be held responsible for damages caused to the computer equipment of Users or third parties during the provision of the Portal service.

  • SERVICE AVAILABILITY

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity, and operation are not the responsibility of ALEJANDRA RAMÍREZ ABOGADOS. Therefore, the services provided through the Portal may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.

ALEJANDRA RAMÍREZ ABOGADOS shall not be liable for any damages or losses of any kind suffered by the User resulting from failures or disconnections in the telecommunications networks that cause the suspension, cancellation, or interruption of the Portal service during its provision or beforehand.

  • THE CONTENTS AND SERVICES LINKED THROUGH THE PORTAL

The Portal access service includes technical linking devices, directories, and even search instruments that allow the User to access other pages and Internet portals (hereinafter, 'Linked Sites'). In these cases, ALEJANDRA RAMÍREZ ABOGADOS acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce ('LSSI') and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of their unlawfulness and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, they may communicate it to ALEJANDRA RAMÍREZ ABOGADOS at abogados@spain-extranjeria.com, without this communication in any case implying the obligation to remove the corresponding link.

In no case should the existence of Linked Sites presuppose the existence of agreements with their responsible parties or owners, nor the recommendation, promotion, or identification of ALEJANDRA RAMÍREZ ABOGADOS with the statements, contents, or services provided.

ALEJANDRA RAMÍREZ ABOGADOS is not aware of the contents and services of the Linked Sites and therefore is not responsible for damages caused by the unlawfulness, quality, truthfulness, unavailability, error, and uselessness of the contents and/or services of the Linked Sites nor for any other damage that is not directly attributable to S-MM.

7.- Payment Method. The Client shall pay the fees through PayPal, credit/debit card, or by bank transfer to the account indicated on the Website or provided by the Firm. These payment methods may entail commission fees or currency exchange costs, which must be borne by the client. The Firm must receive the exact amount agreed upon for the services and not less due to the aforementioned reasons.Fraudulent use of credit cards, or the denial of payment for any reason, entitles ALEJANDRA RAMIREZ ABOGADOS to terminate the contract for the purchased Legal Service, without prejudice to the corresponding civil and criminal liabilities.

8.- Invoicing. If the Client wishes for the Firm to send them the invoice corresponding to the contracted Service by regular mail, they must expressly notify this by email in response to the acknowledgment of receipt of the amount paid. Otherwise, it will be presumed that the Client prefers to receive said invoice by email. Therefore, and in accordance with the provisions of article 164. One, 3rd and Two of Law 37/1992, of December 28, Value Added Tax Law, the Client gives consent to ALEJANDRA RAMIREZ ABOGADOS to issue on their behalf the corresponding invoice in electronic format, as well as to have it sent to them electronically to the email address provided at the time of contract formalization.

9.- Legal Deadlines. In the event that any judicial or administrative authority has granted the Client a deadline to submit documents, carry out procedural or administrative acts, or if the Client is subject to any statute of limitations or expiration period, the Client must contract the corresponding Legal Service in advance and immediately inform ALEJANDRA RAMIREZ ABOGADOS of the existence of such deadline.

10.- Contract Validity. The present General Contract Conditions will be incorporated into the Legal Services lease contract signed with ALEJANDRA RAMIREZ ABOGADOS at the moment the Client gives their consent, which will be understood as given upon signing the document accepting the conditions of the firm for the services described therein.Since this is an electronic contract, the signature of this contract will be replaced by the acceptance of these general conditions made as stated in the previous paragraph.

11.- Incidents and complaints
In the event that the Customer wishes to report any incident or make any claim, he/she may do so by e-mail or regular mail.

12.- Conservation of the contract
If the client wishes to keep a copy of this document, they must print it at the time of contracting. The Law Firm will not individually archive this electronic document for each client through which the contract is formalized.

13.- Data Protection In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, and Royal Decree 1720/2007, of December 21, approving the Regulation for the development of Organic Law 15/1999, the Firm informs that the data provided by the Client will be incorporated and processed in the files owned by Armando Carrillo Romero, as Responsible, for the purpose of developing the established contractual relationship, as well as to receive information on legislative disclosure, articles of interest in legal matters, and other services provided by the Firm through fax, postal or electronic means or other forms of remote communication related to its areas of action. The Client expressly authorizes the processing of personal data that may be collected during the provision of the Legal Service for the purpose described above, among which may include those related to the health of individuals, the commission of criminal or administrative offenses, or any other data that the Client freely communicates to ALEJANDRA RAMIREZ ABOGADOS. Likewise, the Client consents to the communication of their data to those bodies, organizations, entities, or parties involved in the matters entrusted and whose refusal would make such provision impossible. The Client may, at any time, exercise their rights of Access, Rectification, Cancellation, and Opposition. The exercise of these rights can be carried out by written communication to the address: Calle Alameda de Colón, 17, 1º A (Málaga), or by sending an email to the address: abogados@spain-extranjeria.com, accompanying in both cases a copy of the ID. The Client may also exercise these rights in the terms established by the applicable regulations, which can be consulted at www.agpd.es.

14.- Professional Secrecy and Confidentiality
ALEJANDRA RAMIREZ ABOGADOS commits to treating the information accessed during the provision of Legal Services confidentially and subject to professional secrecy, as set forth in its Data Protection Policy.

15.- Term and Duration. The contract will enter into force and take effect from the moment the Client contracts the service (by signing the document accepting services). The contract will have an estimated duration, determined by the Client's receipt of the response to the contracted service, as the response depends on a public entity, either Immigration or the U.G.E. ALEJANDRA RAMIREZ ABOGADOS reserves the right to terminate the contract in case of unauthorized use of the service, whether contravening the provisions of these general terms and conditions of contract or any applicable legal provision. In the event that ALEJANDRA RAMIREZ ABOGADOS terminates the contract for any of the reasons set forth in this clause, no obligation or liability shall accrue to the Firm, and no amount previously paid shall be refunded in these cases.

16.- Conflict of Interest In the event that two Clients with conflicting interests in the same matter coincide, who have entered into a contract with the Law Firm, only the one who submits the query first will be attended to. ALEJANDRA RAMIREZ ABOGADOS will refund the consultation fee to the Client who cannot be answered.

It will therefore be understood that there is a conflict of interest, among other cases, when a claim is made or advice is requested against another Client of the Firm, whether a natural person or a legal entity.

17.- Liability ALEJANDRA RAMIREZ ABOGADOS assumes no responsibility for damages, losses, claims, or expenses caused by: a. Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blocks, and/or disconnections in the operation of the electronic system, caused by deficiencies, overloads, and errors in the telecommunications lines and networks, or for any other cause beyond its control. b. Use of malicious programs of any kind and through any means of communication, such as computer viruses or any others. c. Improper and/or inadequate use of the website pages. d. Security and/or navigation errors caused by malfunctioning of the browser or by the use of outdated versions of it. The Client is aware, and voluntarily accepts, that the use of the website takes place, in any case, under their sole responsibility. The Client shall be liable for damages of any kind that ALEJANDRA RAMIREZ ABOGADOS may suffer as a result of the breach of any of the obligations to which it is subject under these general terms and conditions of service or under the applicable legislation regarding the use of the website and the unauthorized public dissemination of the legal advice provided.

18.- Applicable Law The parties acknowledge that the applicable law to this contract, and to all legal relationships arising therefrom, shall be Spanish law, by express application of the provisions of Article 1,262 of the Civil Code, in relation to the provisions of Chapter IV, Title Preliminary of the same legal body.

This Legal Notice is governed in each and every one of its ends by Spanish law.

19.- Jurisdiction. Provisions not covered by these General Conditions of Use shall be governed by the current Spanish laws. Any dispute not resolved amicably shall be subject to the jurisdiction of the Courts and Tribunals of Madrid in the case of legal entities, and in the case of consumers and users, individuals, to those Courts and Tribunals determined in accordance with current rules of procedural distribution.The current version of the conditions will remain published on the website for consultation. It is, therefore, the user's responsibility to retain a copy of the accepted conditions for any subsequent claims.
